We use the information collected through our text messaging program to communicate with you regarding load updates, dispatch and operational communications, appointment and delivery notifications, driver coordination, account or billing matters, and responses to your inquiries.

4. Consent and Opt-In (TCPA Disclosure)

By providing your mobile phone number and expressly consenting to receive text messages from Next Way, you authorize Freight One Enterprises LLC dba Next Way to send you SMS/MMS messages using automated technology, including but not limited to autodialer systems and prerecorded or artificial voice messages, to the mobile number you provided.

Your consent is entirely voluntary. Consent is not a condition of employment, purchasing any goods or services, or receiving any other benefit. You may revoke your consent at any time.

By opting in, you confirm that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to receiving text messages at that number.

5. Message Frequency and Charges

Message frequency varies based on your interactions with us. Message and data rates may apply depending on your mobile carrier and plan. Next Way does not charge for text messages, but your carrier's standard messaging rates apply. Check with your wireless provider for details on your plan.

6. Opt-Out

You may opt out of receiving text messages at any time by replying STOP to any message from us. After opting out, you will receive a single confirmation message, and no further texts will be sent unless you re-enroll. You may also opt out by contacting us directly using the information in Section 14.

7. Help

For help or information about our texting program, reply HELP to any message or contact us using the information in Section 14.

8. Supported Carriers

Our text messaging program is supported on major U.S. wireless carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.

9. Sharing of Information

We do not sell, rent, lease, or share your phone number or any personal information collected through our text messaging program with third parties for their marketing or promotional purposes. We may disclose information to third-party service providers who assist us in delivering text messages (e.g., SMS platform vendors), but only to the extent necessary to operate the program. We may also disclose information as required by law, regulation, subpoena, court order, or other legal process.

10. No Sharing With Third Parties for Marketing

We will never share your opted-in phone number or personal data obtained through our SMS program with any third party for that third party's own marketing use. This includes affiliates, partners, and advertisers.

11. Data Retention

We retain your phone number, opt-in records, and messaging logs only as long as necessary to fulfill the purposes described in this policy, to comply with legal obligations, or as required under the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations. Opt-in consent records are maintained for a minimum of four (4) years.

We use reasonable administrative, technical, and physical safeguards to protect the personal information collected through our text messaging program from unauthorized access, disclosure, alteration, or destruction.

13. Children's Privacy

Our text messaging program is not intended for individuals under the age of 18. We do not knowingly collect personal information from minors through SMS/MMS.
