SMS/Text Messaging Privacy Policy

1. Introduction

This SMS/Text Messaging Privacy Policy explains how Freight One Enterprises LLC dba Next Way (“Next Way,” “we,” “us,” or “our”) collects, uses, and protects information related to text messages (SMS/MMS) we send and receive. Our SMS program is for driver job applicants who opt in to receive texts about their job application and about driver job openings.

2. Information We Collect

When you opt in to receive text messages, we may collect your mobile phone number, your name, the content of messages, the date and time of messages, and your opt-in and opt-out status.

3. How We Use Your Information

We use this information to send and manage:

• Application received confirmations
• Interview and orientation scheduling
• Document requests related to your application (CDL, MVR, etc.)
• Driver job openings and recruiting offers (marketing messages, sent only if you separately opt in to them)
• Responses to your inquiries

4. Consent and Opt-In (TCPA Disclosure)

By providing your mobile number and expressly consenting, you authorize Next Way to send text messages to that number, including messages sent using automated technology such as autodialers and prerecorded or artificial voice messages. Consent is voluntary and is not a condition of employment, purchase, or any other benefit. Application update texts and recruiting (marketing) texts each require their own separate consent, and you may agree to one without the other. You may revoke consent at any time. By opting in, you confirm that you are the subscriber or regular user of the mobile number provided and are authorized to consent.

5. Message Frequency and Charges

Message frequency varies based on your interactions with us. Message and data rates may apply depending on your carrier and plan. Next Way does not charge for text messages, but your standard carrier rates apply. Please check with your wireless provider for details.

6. Opt-Out

You can stop receiving text messages at any time by replying STOP to any message. You will receive one confirmation message, and no further messages will be sent unless you re-enroll. You may also opt out by contacting us as described in Section 14.

8. Supported Carriers

Our program is supported on major U.S. carriers, including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.

9. Sharing of Information

We do not sell, rent, lease, or share your mobile phone number or program information with third parties for their marketing purposes. We may share information with service providers, such as SMS platform vendors, only as needed to operate the program. We may also disclose information when required by law, including in response to a subpoena, court order, or other legal process.

10. No Sharing With Third Parties for Marketing

Mobile phone numbers and SMS opt-in data are never shared with any third party for that party’s own marketing purposes, including affiliates, partners, and advertisers.

11. Data Retention

We retain phone numbers, opt-in records, and messaging logs only as long as necessary for the purposes described in this policy, to comply with law, or to meet TCPA and FCC requirements. Opt-in consent records are retained for at least four years.

12. Security

We use reasonable administrative, technical, and physical safeguards to protect program information from unauthorized access, disclosure, alteration, or destruction.

13. Children's Privacy

Our SMS program is not intended for anyone under 18, and we do not knowingly collect information from minors through SMS/MMS.
